Food safety law & responsibilities

Why food safety law exists

Food law protects customers from harm and protects the business from prosecution. In England, Wales and Scotland the main law is the Food Safety Act 1990, backed up by the Food Hygiene (England) Regulations 2006 (and the equivalent Wales/Scotland/NI regulations) plus retained EU Regulation 852/2004 on the hygiene of foodstuffs. Northern Ireland has its own near-identical regulations.

Who enforces it

Environmental Health Officers (EHOs), employed by the local authority, are the main enforcers. They can enter food premises at any reasonable time without an appointment, inspect records, take samples, and issue notices. Food Standards Agency (FSA) inspectors take the lead on meat plants and some approved premises.

The offences

  • Selling food not of the nature, substance or quality demanded — for example short weight or a burger that is not 100% beef when labelled as such.
  • Selling food that is unfit for human consumption, or injurious to health.
  • Falsely or misleadingly describing or labelling food.

All three are offences even if no one actually gets ill — it is the risk and the deception that count.

Enforcement powers, weakest to strongest

  • Informal advice — the most common outcome of a routine inspection.
  • Hygiene Improvement Notice — written notice giving a minimum of 14 days to fix a specific problem.
  • Voluntary closure — the business agrees to shut and fix the issue.
  • Hygiene Emergency Prohibition Notice — immediate closure where there is an imminent risk to health; must be confirmed by a magistrate within 3 days.
  • Prosecution — can lead to unlimited fines and up to 2 years' imprisonment for the most serious cases.

Who is responsible

Every food handler has a personal legal duty of care. The proprietor (owner/employer) carries overall responsibility for food safety management, including having a documented HACCP-based system. Managers must supervise, train and instruct staff to a level appropriate to their work — this is a legal requirement, not just good practice.

Common mistakes candidates make

  • Confusing 'unfit for human consumption' (spoiled/contaminated) with 'not of the substance demanded' (mislabelled/adulterated) — they are separate offences.
  • Thinking only the owner can be prosecuted — individual employees can also be prosecuted for their own actions.
  • Assuming an EHO always needs advance notice to inspect — they do not.
  • Forgetting the 14-day minimum on an Improvement Notice.

Bacteria, contamination & allergens

What counts as a hazard

Food safety hazards fall into four groups: biological (bacteria, viruses, moulds), chemical (cleaning chemicals, pesticides, allergens are often grouped separately), physical (glass, metal, hair, plasters) and allergenic. Bacteria are the biggest cause of food poisoning by far.

The bacteria that come up again and again

  • Salmonella - linked to raw poultry, eggs and untreated milk; causes diarrhoea and fever.
  • Campylobacter - the UK's most common cause of food poisoning, linked to raw/undercooked poultry and untreated milk.
  • E. coli O157 - linked to raw or undercooked beef (especially minced beef) and unwashed veg; very low infective dose, can be fatal, common in young children and the elderly.
  • Listeria - grows even in the fridge (unusual - most bacteria don't), found in soft cheeses, pate and chilled ready-to-eat foods; dangerous for pregnant women.
  • Staphylococcus aureus - lives on skin, nose and in cuts; food handlers are a major source via poor hand hygiene.
  • Bacillus cereus - linked to reheated rice and starchy foods left at room temperature.
  • Clostridium perfringens - linked to large batches of meat/poultry cooled too slowly.

What bacteria need to multiply (FAT TOM)

Food, Acidity (neutral pH is riskiest), Time, Temperature, Oxygen, Moisture. The danger zone is 8°C to 63°C - bacteria multiply fastest around 37°C (body temperature), roughly doubling every 10-20 minutes in ideal conditions. That is why high-risk food should not sit in the danger zone for more than 2 hours total (the 2-hour/4-hour rule for food out of temperature control).

Contamination routes

  • Cross-contamination: pathogens transferring from raw food, hands, cloths, surfaces or equipment onto ready-to-eat food - the single most common practical exam theme.
  • Colour-coded chopping boards prevent this: red=raw meat, blue=raw fish, yellow=cooked meat, green=salad/fruit, brown=veg, white=bakery/dairy.
  • Personal hygiene failures (not washing hands after the toilet, touching face/hair, working while ill) are a classic root cause.

Allergens - the specific rule to know

UK law (Food Information Regulations, built on the EU list) requires 14 listed allergens to be declared: celery, cereals containing gluten, crustaceans, eggs, fish, lupin, milk, molluscs, mustard, tree nuts, peanuts, sesame, soybeans and sulphur dioxide/sulphites (at above 10mg/kg or 10mg/litre). Since Natasha's Law (October 2021), pre-packed for direct sale (PPDS) food made on the premises and sold from the same site must show a full ingredients list with the 14 allergens emphasised (bold, underlined or coloured).

Common mistakes to avoid in the exam

Don't confuse food poisoning bacteria with food spoilage organisms (spoilage makes food look/smell bad but isn't the main cause of illness). Don't say the danger zone is only about the fridge - it is any temperature between 8°C and 63°C. Remember allergen information must be available even for food that isn't pre-packed - verbally or via a sign, but it must be accurate.

Temperature control, cooking & storage

Why temperature control matters

Bacteria multiply fastest between 8°C and 63°C — this is called the danger zone.

Good food handlers keep food out of this zone as much as possible, because time plus warmth is what lets bacteria grow to dangerous numbers.

Cold storage rules

  • Fridges must hold food at 8°C or below by law, but best practice aims for 5°C or below.
  • Freezers should run at -18°C or colder.
  • Check fridge and freezer temperatures at least once a day and keep a written record (a due diligence record).
  • Store raw meat, poultry and fish on the bottom shelf, always below ready-to-eat food, to stop drips causing cross-contamination.
  • Do not overload a fridge — air needs to circulate for it to cool properly.

Cooking and reheating

  • Food must be cooked to a core temperature of 75°C (or equivalent, such as 70°C for two minutes) to make sure harmful bacteria are destroyed.
  • Always check the thickest part of the food with a clean, calibrated probe thermometer.
  • Reheated food must also reach 75°C core temperature — and food should only ever be reheated once.
  • Never mix old and new batches of food together.

Hot holding and displaying food

  • Hot food being held for service must be kept at 63°C or above.
  • If hot food drops below 63°C it can only be held safely for up to two hours before it must be thrown away or rapidly reheated to 75°C.

Cooling food safely

  • Cooked food that needs to be chilled should be cooled as quickly as possible, ideally within 90 minutes, before going into the fridge.
  • Never put hot food straight into a crowded fridge — it raises the temperature of everything else and pushes other food into the danger zone.
  • Use shallow containers, a blast chiller, or an ice bath to speed cooling.

The four-hour and two-hour rules

  • Food can be out of temperature control for up to two hours and still be used, chilled, or safely served once, then it must go back in the fridge.
  • Food left out of the danger zone for more than four hours in total must be thrown away — it cannot be put back in the fridge.

Common exam mistakes

  • Confusing 8°C (legal fridge limit) with 5°C (best practice target).
  • Forgetting freezers need to be -18°C, not just 'cold'.

Personal hygiene & illness rules

Why personal hygiene matters

Food handlers are one of the biggest sources of contamination. Skin, hair, nose, mouth and gut all carry bacteria that can transfer to food through hands, coughs, sneezes or dirty clothing. Good personal hygiene is a legal duty under food safety law, not just good manners.

Handwashing

  • Wash hands with warm water and liquid soap, then dry properly with paper towel or air dryer - a wet hand spreads more germs than a dry one.
  • Always wash hands: before starting work, after using the toilet, after handling raw food (especially raw meat, poultry, fish and eggs), after touching bins, cleaning chemicals or your face/hair, after breaks, smoking or eating, and after blowing your nose.
  • Nail brushes should be used if hands are visibly soiled; nails should be kept short, clean and free of varnish or false nails.
  • Cuts and grazes on hands must be covered with a waterproof, brightly-coloured (usually blue) detectable plaster, ideally with a blue plaster underneath a glove too.

Protective clothing

  • Wear clean protective clothing (whites/apron) kept only for work - never wear it to travel to and from work.
  • Change it if it becomes dirty or contaminated during a shift.
  • Remove aprons before using the toilet.
  • Tie hair back or wear a hat/hairnet to stop hair falling into food.
  • Jewellery should be kept to a minimum - normally only a plain wedding band and stud earrings are allowed; watches, rings with stones and bracelets must be removed as they harbour bacteria and can be a physical hazard.

Illness rules

  • Anyone with diarrhoea and/or vomiting MUST report it and MUST NOT work with food.
  • They must stay off work until symptom-free for at least 48 hours - this is the key legal figure to remember.
  • Certain infections (e.g. typhoid, some E. coli strains) may need medical clearance and a longer exclusion before returning.
  • Skin infections, boils, septic cuts, discharge from eyes/ears/nose, and persistent coughing/sneezing linked to illness must also be reported to the supervisor before starting work.
  • All food handlers have a legal duty to report illness to their employer - this is set out under food safety regulations (based on Regulation (EC) 852/2004).

Common mistakes to avoid

  • Coming to work "just in case" during the 48-hour exclusion period after sickness.
  • Assuming a plaster alone is enough without a glove on top for high-risk tasks.
  • Smoking or eating in food preparation areas.
  • Touching your face, hair or phone then handling food without rewashing hands.
  • Stay off work for at least 48 hours after symptoms of diarrhoea and/or vomiting have stopped.

Cleaning, disinfection & pest control

Why cleaning and disinfection matter

Cleaning removes dirt, food debris and grease. Disinfection reduces bacteria to a safe level. Sanitising means doing both together, either in one step or as cleaning followed by disinfection. Cleaning alone does not kill bacteria - it just removes the food source they feed on and physically strips most of them away, but any left behind can multiply fast on a surface that looks spotless.

The six stages of cleaning

This is the classic sequence and it comes up constantly in exams:

  • Pre-clean - remove loose debris and rinse off heavy soiling
  • Main clean - use hot water and detergent to break down grease and dirt
  • Rinse - remove the detergent and loosened dirt
  • Disinfect - apply a disinfectant or sanitiser to kill remaining bacteria
  • Final rinse - remove disinfectant residue (only needed for some chemicals)
  • Dry - air dry where possible, or use disposable paper towels; cloths spread bacteria

Chemical rules

Always follow the manufacturer's instructions for dilution, contact time and temperature - using less than instructed is a common exam trap and a real hazard because it will not work. Disinfectants and sanitisers need the correct contact time on the surface, often around 5 minutes for many products, to actually kill bacteria. Never mix chemicals together, especially bleach with other cleaning products, because this can produce toxic fumes. Chemicals must be stored away from food, correctly labelled, and never decanted into old food or drink containers.

Cleaning schedules

A cleaning schedule sets out what is cleaned, how, how often, by whom, what chemicals and equipment to use, and the safety precautions. It should be followed and checked, with records kept as evidence for EHO inspections.

Colour-coded equipment

Colour coding prevents cross-contamination between food types and cleaning zones, for example red for raw meat, blue for raw fish, green for salad and fruit, yellow for cooked meat, white for bakery and dairy, and brown for vegetables. The same principle applies to cleaning cloths and mop heads for different areas such as toilets versus food areas.

Pest control

Common food premises pests include rodents (mice and rats), flying insects (flies), crawling insects (cockroaches, ants) and stored product pests. Signs of infestation include droppings, gnaw marks, damaged packaging, nesting material, smear marks and, for insects, live or dead bodies and eggs.

Proofing the building is the first line of defence: keep doors closed, fit fly screens and air curtains, seal gaps and holes, keep external areas clean and bins covered and away from the building, and store food off the floor and away from walls to allow inspection. Report signs of pests immediately and do not attempt DIY pesticide use in a food business - use a registered, competent pest control contractor. Keep pest control records as due diligence evidence.</br>Good housekeeping (no food debris, no standing water, no clutter) removes food and harbourage, making the premises far less attractive to pests in the first place.

Premises, layout and design

Food premises must be kept clean, in good repair and designed to allow good hygiene practice, including protection against contamination and pest access. Layout should ideally follow a one-way flow from dirty (deliveries, waste) to clean (preparation, service) areas, avoiding cross-over between raw and ready-to-eat processes.

Structural requirements

  • Walls, floors and ceilings must be smooth, durable, non-absorbent and easy to clean - no flaking paint or bare wood in food areas.
  • Floors need to be slip-resistant and coved at wall joints to stop dirt traps.
  • Adequate lighting and ventilation are required, with ventilation directed to avoid contaminating food (extract away from prep surfaces).
  • Hand wash basins must be separate from food prep sinks, with hot and cold running water, soap and hygienic drying (paper towels, not cloth towels).
  • Adequate space and facilities for waste storage, away from food areas, with lidded bins.

HACCP basics

HACCP stands for Hazard Analysis and Critical Control Points - a legal requirement under food law for every food business to have a food safety management system based on HACCP principles. There are 7 principles: identify hazards, determine critical control points (CCPs), set critical limits, establish monitoring, set corrective actions, verify the system works, and keep records/documentation.

A CCP is a point where control is essential to prevent or eliminate a hazard - for example, the cooking step for chicken (core temperature 75C for 30 seconds, or equivalent time/temperature combination) is a classic CCP.

Records and monitoring

Records prove due diligence - the legal defence that shows all reasonable precautions were taken. Common records include fridge/freezer temperature checks, cooking and probe temperature logs, delivery checks, cleaning schedules and staff training records.

  • Fridges should run at 8C or below (best practice 5C or below); freezers at -18C or below.
  • Records must be kept up to date, accurate and available for EHO inspection - a common mistake is filling records in advance ('dry labbing') or in a batch after the shift, which is dishonest and undermines due diligence.
  • Corrective action must be written down whenever a limit is breached, not just the temperature itself.

Common exam traps

Don't confuse a CCP with a general control point - a CCP is one where loss of control creates an unacceptable risk. Records with no signature, date or corrective action are considered incomplete. Many candidates forget that HACCP-based systems must be reviewed and updated whenever the menu, process or premises change.
