Legal duties, reporting & site induction

Why legal duties matter

UK health and safety law is built on the Health and Safety at Work etc. Act 1974, backed up by the Construction (Design and Management) Regulations 2015, known as CDM 2015. These laws set out who is responsible for what on a construction site, and they apply to everyone from the client to the labourer.

Everyone has a duty

  • Employers must give a safe place of work, safe equipment, training, and supervision.
  • Employees and the self-employed must take reasonable care of themselves and others, and cooperate with their employer on safety matters.
  • You must not interfere with or misuse anything provided for health and safety.
  • Duty of care is a two-way street - management provides the system, workers must use it properly.

CDM 2015 duty holders

  • Client: makes sure suitable arrangements are in place for the whole project.
  • Principal designer: manages health and safety during the pre-construction phase.
  • Principal contractor: plans, manages and monitors the construction phase.
  • Contractors and workers: follow the plan, use the right equipment, and report problems.

Reporting - RIDDOR

RIDDOR stands for the Reporting of Injuries, Diseases and Dangerous Occurrences Regulations 2013. Employers (not individual workers) must report to the HSE:

  • Deaths and specified major injuries (e.g. fractures other than fingers/toes/thumbs, amputations, loss of sight).
  • Over-7-day injuries, where a worker cannot do their normal duties for more than 7 consecutive days.
  • Dangerous occurrences, such as scaffold collapse, even if nobody was hurt.

A common mistake is thinking any minor cut needs a RIDDOR report - it does not. Minor injuries just go in the site accident book, which every site must have.

Near misses

A near miss is an event that could have caused harm but did not. You must always report near misses to your supervisor - they are free lessons that prevent future accidents. Never ignore one because 'nothing happened'.

Site induction

Every worker must attend an induction before starting work on a new site, no matter how experienced they are. It covers emergency procedures, fire points, first aid location, welfare facilities, site rules, permit-to-work systems, and who to report hazards to. Skipping induction, even for a 'quick job', is a common and serious mistake - inductions exist because every site has different risks and layouts.

Stopping work

Any worker has the right, and the duty, to stop work and report immediately if they believe there is a serious and imminent danger. You will not be penalised for this - it is called your 'right to stop work'.

  • The Health and Safety at Work etc. Act 1974 is the main law placing duties on employers and employees in the UK.
  • CDM 2015 (Construction Design and Management Regulations 2015) sets out duties for clients, designers, principal contractors and workers on construction projects.
  • RIDDOR 2013 requires employers to report deaths, specified major injuries, and dangerous occurrences to the HSE.
  • An over-7-day injury (unable to do normal duties for more than 7 consecutive days, not counting the day of the accident) must be reported under RIDDOR.
  • RIDDOR reports must be made by the employer or responsible person, never by the injured worker directly to HSE.
  • Minor injuries and first-aid-only cases go in the site accident book, not a RIDDOR report.
  • A near miss is an incident with potential to cause harm that did not, and it must still be reported to a supervisor.
  • Every worker, however experienced, must attend a site induction before starting work on a new site.
  • Site induction covers emergency procedures, fire assembly points, first aid provision, welfare facilities and site-specific rules.
  • Every worker has the legal right to stop work if they believe there is serious and imminent danger, without fear of penalty.
  • Employees must cooperate with their employer and must not misuse anything provided in the interests of health and safety.
  • The self-employed have the same basic duty of care for their own safety and that of others as employees do.

Working at height

What counts as working at height

Working at height means any work where a person could fall and injure themselves - this includes working on ladders, scaffolds, roofs, mobile towers, near fragile surfaces, near excavations, or even at ground level next to a hole or opening. It is not just about being high up - falling from any level that could cause injury counts.

The law behind it

The Work at Height Regulations set out a clear hierarchy that every site must follow:

  • Avoid working at height if you possibly can
  • If you cannot avoid it, use equipment to prevent falls, such as guardrails or scaffolding
  • If a fall cannot be prevented, use equipment to minimise the distance and effect of a fall, such as nets or airbags
  • Personal fall protection is always the last resort, not the first choice

Guardrails and edge protection

Where there is a risk of falling, edge protection is needed. The standard is a top guardrail at a minimum of 950mm above the edge, plus a mid-rail so there is no unprotected gap bigger than 470mm, plus a toe board to stop tools and materials falling. Never remove guardrails without putting a barrier or warning system in place, and always put them straight back.

Ladders

Ladders should only be used for light, short-duration work - generally no more than 30 minutes at a time. Always maintain three points of contact. A leaning ladder should be angled at 75 degrees, which is often remembered as the 1 in 4 rule - one unit out for every four units up. Ladders must be secured (tied, footed, or fitted with an effective stability device) and inspected before use.

Fragile surfaces

Roof lights, old asbestos sheets, and corroded roof panels can look solid but will not take a person's weight. Never step directly on a fragile surface - always use crawling boards, staging, or edge protection, and warning signs must be displayed where fragile roofs exist.

Weather and equipment checks

Work at height should stop or be reviewed in strong winds, ice, or heavy rain, as these dramatically increase fall risk. All access equipment - scaffolds, towers, harnesses, ladders - must be inspected regularly by a competent person, and scaffolds need a tag system showing the last inspection date.

Common mistakes to avoid

  • Overreaching from a ladder instead of moving it
  • Using a stepladder on uneven ground without checking it is stable
  • Leaving guardrails off after removing them for material loading
  • Assuming a harness alone makes a job safe - it only reduces injury after a fall, it does not prevent one
  • Working at height alone with no one aware in an emergency
  • Guardrails need a top rail at a minimum of 950mm and no gap greater than 470mm
  • Leaning ladders should be set at a 75 degree angle - the 1 in 4 rule
  • Always keep three points of contact when climbing a ladder
  • Ladders are for light work only, generally under 30 minutes at one position

Manual handling & lifting operations

Why manual handling matters

Manual handling injuries (bad backs, strains, hernias) are one of the biggest causes of lost time in construction. The law that covers this is the Manual Handling Operations Regulations. The golden rule: avoid manual handling if you can, assess the risk if you cannot avoid it, and reduce the risk as far as reasonably practicable.

The hierarchy

  • First, ask if the load can be avoided altogether - can a machine, trolley or crane do it instead?
  • Second, assess the risk using the load, individual, task and environment factors.
  • Third, reduce the risk - break the load down, get help, use lifting aids, improve the route.

Guideline weight figures

  • These are NOT legal limits - they are guideline figures for a two-handed lift in good conditions, close to the body, between knuckle and shoulder height.
  • Men: guideline figure of 25kg.
  • Women: guideline figure of 16kg.
  • The figures reduce significantly if the load is lifted above shoulder height, below knee height, or held at arm's length away from the body.
  • Twisting while carrying a load cuts the safe amount you should lift.

Correct lifting technique

  • Plan the lift - check the route is clear and you know where the load is going.
  • Get a firm grip, feet apart, one foot slightly forward for balance.
  • Bend the knees, keep the back straight (not necessarily vertical) and keep the load close to the body.
  • Lift smoothly using the leg muscles, not a jerky motion.
  • Avoid twisting the back - move the feet to turn instead.
  • Put the load down first, then adjust its position.

TILE assessment

When judging if a lift is safe, remember TILE:

  • Task - does it involve twisting, stooping, long carrying distances or repetitive lifting?
  • Individual - does the person have the strength, training and fitness for this lift?
  • Load - is it heavy, bulky, sharp, hot, unstable or hard to grip?
  • Environment - is the floor uneven, wet, cluttered, poorly lit, or is there enough space?

Common mistakes to avoid

  • Lifting with a bent back and straight legs.
  • Twisting the spine while holding a load.
  • Guessing the weight instead of checking labels or asking.
  • Trying to carry a load alone that clearly needs two people or a mechanical aid.
  • Ignoring pain or discomfort and continuing to lift.
  • Carrying loads that block your view of the route ahead.

Team lifting and aids

If a load needs two or more people, one person should call clear instructions so lifts and lowers are coordinated. Always use lifting aids (trolleys, hoists, sack barrows) where provided rather than relying on brute strength.

Hazardous substances, dust & asbestos awareness

What counts as a hazardous substance

Hazardous substances include dust, fumes, gases, vapours, liquids and mists that can harm your health if you breathe them in, swallow them, or get them on your skin. On site this covers cement, silica dust, wood dust, solvents, isocyanates in some paints and foams, cleaning chemicals, and asbestos.

The law - COSHH

Control of Substances Hazardous to Health (COSHH) is the law covering hazardous substances at work. Every substance that could harm health should have a COSHH assessment before work starts. Always check the safety data sheet (SDS) and the site COSHH assessment before you use or disturb a product you are not familiar with.

Silica dust

Respirable Crystalline Silica (RCS) comes from cutting, drilling, grinding or sanding materials like concrete, brick, mortar and stone. It causes silicosis and lung cancer and you cannot see the dangerous fine particles in the air. Control it with water suppression, on-tool extraction (LEV), and RPE where exposure cannot be controlled another way.

Wood dust

Hardwood dust is a known cause of nasal cancer. Softwood and hardwood dust both cause asthma and other lung disease over time. Extraction and RPE apply just as they do for silica.

The control hierarchy

Under COSHH you must work through control measures in order: eliminate the substance, substitute it for something safer, use engineering controls such as extraction, then use safe systems of work, and only rely on PPE/RPE as the last resort. Never treat a dust mask as the first answer - fix the source first.

Asbestos awareness

Asbestos was banned from use in the UK in 1999 but is still present in many buildings built or refurbished before 2000. It causes mesothelioma, lung cancer and asbestosis, often decades after exposure - there is no safe level of exposure. The three main types referred to by colour are blue (crocidolite), brown (amosin) and white (chrysotile); blue and brown are the most dangerous.

If you suspect asbestos

Stop work immediately, do not disturb the material, isolate the area, and report it to your supervisor. Never sweep, drill, cut, sand or vacuum a suspected asbestos material with an ordinary vacuum - this releases fibres into the air. Wait for a licensed surveyor or removal contractor.

Common exam mistakes

People confuse COSHH (the general law on hazardous substances) with the specific Control of Asbestos Regulations. Others assume dust masks are always adequate protection - they are not for fine silica dust, which needs proper RPE fit-tested to the individual. Remember: if in doubt about any material, stop and ask - never guess.

Plant, vehicles & site transport

Plant, vehicles and site transport

Site transport kills and maims more than almost any other hazard on site. The test wants you to know who is in charge, what the rules are, and what the common failures look like.

The traffic management plan

Every site with vehicle movements needs a traffic management plan. It should keep pedestrians and vehicles apart wherever possible - separate routes, barriers, and clearly marked walkways. Where separation is not possible, use crossing points, signage and banksmen. One-way systems reduce reversing, which is one of the biggest killers on site.

Reversing vehicles

Reversing is one of the most dangerous vehicle movements. Vehicles should be banked back by a trained banksman using clear, agreed signals. The banksman must stay in the driver's full view at all times - if you lose sight of each other, stop. Never walk behind a reversing vehicle, even briefly, and never assume the driver has seen you; catch their eye or wait for a signal.

Exclusion zones

Moving plant such as excavators, dumpers and cranes must have an exclusion zone around it. Only trained, authorised operators and banksmen should be inside that zone. Never walk under a suspended load or within the swing radius of a slewing excavator.

Operator competence

Only trained and certificated operators (for example CPCS or NPORS card holders) may drive or operate plant. If you are not trained on it, do not touch it, even to move it a short distance.

Seatbelts and high-visibility clothing

Seatbelts must be worn in any plant fitted with them, including dumpers - dumper rollovers are a major cause of death because drivers are thrown out or crushed. High-visibility clothing must be worn wherever vehicles operate, so drivers can see you against the background.

Pre-use checks

Operators must carry out daily pre-use checks (brakes, lights, mirrors, tyres, warning devices) before using any vehicle or plant. Report defects immediately and do not use defective equipment - take it out of use and tag it.

Common mistakes to avoid

  • Walking through an exclusion zone because it looks clear
  • Assuming a reversing alarm means the driver can see you
  • Standing on a dumper or riding in the bucket of an excavator
  • Overloading a dumper or driving across steep ground with a raised skip
  • Ignoring pedestrian routes because the vehicle route looks quicker

Remember: pedestrians and vehicles should be kept apart by segregation first, and by procedure (banksmen, signals, exclusion zones) only where segregation is not possible.

Fire, emergencies, noise, vibration & PPE

Fire on site

Fire needs three things: fuel, oxygen and heat (the fire triangle). Remove any one and the fire goes out.

  • If you discover a fire, raise the alarm first, then leave by your nearest safe route.
  • Never tackle a fire unless you have been trained, it is small, and you have a clear escape route behind you.
  • Know your assembly point before you need it, and always go straight there.
  • Fire doors must never be wedged open - they hold back smoke and flames.
  • Keep escape routes and fire points clear of stored materials at all times.

Fire extinguishers by colour

Extinguishers are colour-coded so you grab the right one fast.

  • Red (water) - wood, paper, textiles. Never use on electrical fires or flammable liquids.
  • Cream (foam) - flammable liquids.
  • Black (CO2) - electrical fires.
  • Blue (dry powder) - multi-purpose, good for vehicle fires.
  • Yellow (wet chemical) - cooking oils and fats.

Noise

Noise damage is permanent and painless until it is too late - you will not feel it happening.

  • Lower exposure action value: 80 dB - employer must provide hearing protection if asked and assess risk.
  • Upper exposure action value: 85 dB - employer must provide hearing protection and mark hearing protection zones.

Vibration

Vibration causes Hand-Arm Vibration Syndrome (HAVS) - tingling, numbness and eventually permanent damage to hands and fingers ('vibration white finger').

  • Report tingling or numbness in fingers immediately - do not carry on and hope it passes.
  • Reduce exposure time on vibrating tools, keep hands warm, and grip tools as lightly as possible.
  • Whole body vibration comes from vehicles and machinery over rough ground.

PPE (Personal Protective Equipment)

PPE is the last line of defence, used after other controls have reduced the risk as far as possible.

  • PPE is free and provided by the employer - workers must never be charged for it.
  • It's the worker's duty to wear PPE correctly, look after it, and report damage or loss straight away.
  • Common mistake: wearing damaged or ill-fitting PPE - if it does not fit or is broken, it will not protect you.
  • Always check PPE before use and store it properly when not in use.

Common exam traps

  • Mixing up 80 dB, 85 dB and 87 dB noise levels.
  • Thinking you can tackle any fire yourself.
